经最高人民法院核准，国家药监局原局长郑筱萸7月10日在北京被执行死刑。国家药监局医疗器械司原司长郝和平因犯受贿罪和非法持有枪支罪一审被判处有期徒刑十五年，药品注册司原司长曹文庄因犯受贿罪被判处死缓。
上午8时许，郑筱萸被提出监室，两名法警将他带到一个房间里，接受刑前的验明证身。这一天清晨，从市区驶出一辆警车，北京市一中院的执行法官赶到秦城监狱。他们向郑筱萸宣读了最高法院的死刑核准裁定和执行死刑命令。
郑筱萸木然地听着法官们的宣读，平静地接受这一切，平静地聆听着死神的召唤。
法官宣读毕，按着人道主义原则，是郑筱萸个人支配的时间。法官们为他提供了纸和笔，他坐在桌前，拿起笔，开始书写遗嘱。大约写了半个小时，他写得十分认真，给妻子、儿子留下了他一生中最后的嘱托。
上午9时许，妻子刘耐雪赶来了，郑筱萸获准同妻子见了最后一面。面对泪痕满面的妻子，郑筱萸显得很平静，法警们退出房间，屋里只有郑筱萸与妻子两人。
半小时的会见转瞬即逝，在妻子的痛哭声中郑筱萸离去了，他被押上一辆死刑执行专用车。他按照法警的要求躺在特制的床上，微微地闭上了双眼。一位法警手持注射器走到他的面前，将针管轻轻扎进他的手臂。
郑筱萸如同以往生病就医一般，静静地躺在那里。仿佛这一针打完，不过是睡个觉，还会有醒来的时候。随后，针管中的液体流入他的体内，一会儿，他便失去了知觉，平静地入睡了。
郑筱萸被以注射死刑的方式结束了生命。12时许，新华社就此发表新闻——经最高人民法院核准，国家食品药品监督管理局原局长郑筱萸10日上午在北京被执行死刑……
这次死刑判决与执行之所以引起轰动甚至“震撼”，很重要的一个原因在于，这个通过其妻、子非法受贿600多万元的省部级高官，被判处极刑，超出了很多人的想象和猜测。此前，有些比郑筱萸“好处捞得更多”的高官也没受到如此“待遇”。
那么，郑筱萸为何落得如此下场？人们注意到，在判决书中除“受贿数额特别巨大”外，还有一段“犯玩忽职守罪，使国家和人民利益遭受重大损失，情节特别严重，遂依法作出死刑判决”的醒目之语。因“使人民利益遭受重大损失”而罪至极刑，郑筱萸案亮出了一个新的信号。
这一点，在《人民日报》和新华社的特约评论员文章中也得到了充分的印证。这两篇内容相同的文章，标题就是“人民利益高于一切”。文章指出，中央“始终高度重视民生问题，历来把人民利益高于一切作为制定政策、做工作的出发点和落脚点”。而作为国家食品药品监督管理局原主要负责人的郑筱萸“为了一己之私，不惜利用权力大肆收受贿赂，玩忽职守……严重危害了人民群众用药安全及生命健康安全，造成了极其恶劣的社会影响”。他“落得身败名裂、倾家荡产的下场，罪有应得”。文章特别强调：“任何侵害人民利益的行为，任何对工作草率从事、敷衍塞责，甚至玩忽职守的行为，都是不能容许的，必须依纪依法予以严惩”。
这些说法以鲜明的立场向人们表明，郑筱萸案的重判，追求的绝对不是对贪官“杀一儆百”之效，而是不管是谁，只要侵害了人民利益，“使人民利益遭受重大损失”，都将遭到国法的严惩。所以，从这点来说，郑筱萸被重判实际上是体现了中央高层对现实中存在的“侵害人民利益”的不法官商和特殊利益集团坚定不移惩治的决心。
郑筱萸在被执行死刑前的忏悔中说到：“令我没有想到的是，舆论一片叫好声，大家咬牙切齿地鼓掌欢呼。这引起了我的反思。我为什么会激起这么大的民愤？原来是我这个部门太重要了，我这个岗位太重要了，我手中的权力直接关系到人民群众的生命安全！我虽然没有亲手杀人，但由于我的玩忽职守，由于我的行政不作为，使假药盛行，酿成了一起又一起惨案。这个帐我是应该认的。我今天能死，主要是因为我这个岗位的责任太大，如果我在其它的局级或部级岗位上，即使是受贿的额度再大点，也不至于掉脑袋。我的悲剧使我得出了一条经验，那就是当官不要当重要岗位上的官，并不是权力越大越好；再有就是当官一定要负责任！不要以为当官是什么好“玩”的事，不负责任的结果最后很可能就是我这样的下场！”
郑案重判是实现公平正义的重要举措。在现在的腐败官员和不法商人中，类似“侵害人民利益的行为”、“使人民利益遭受重大损失”的绝对不是个别现象；除了郑筱萸，还有许多“王筱萸”、“李筱萸”、“张筱萸”……这些靠攫取人民财富谋取特殊利益的不法官商的存在，不仅是“民怨沸腾”的最大制造者和“鼹鼠群”。

2007年7月10日，经最高人民法院核准，郑筱萸以受贿罪、玩忽职守罪两罪并罚，被执行死刑，但关于郑筱萸在任期间乱批新药的疯狂传说并没有随之止息，其中之一便是原国家食品药品监督管理局一年内曾审批一万多种新药，相当于美国FDA八九十年的审批量。
这种说法至今仍甚嚣尘上，甚至只被当事人——原国家食品药品监督管理局反驳过一次，不过，最终似乎也没能改变大家对郑筱萸时代的印象。
当然，如今严峻的药品审批形势下，不少外资制药企业私下觉得，郑的时代虽然批了很多仿制药，助长了中国医药行业的多小散乱，但是，很多好药也都被批了下来。
而一些本土制药企业则坦诚，他们一些销售上亿元的品种，如果按照2007年以后的标准，根本不可能被批准。
可以说，那个时代是制药企业的盛宴，泥沙俱下，而又生机勃勃。
那么问题来了，在郑筱萸的任内，到底有没有一年批准过一万个新药呢？这件事到了今天，很多人依然是一头雾水。
双重证据，似乎难以辩驳
在郑筱萸落马之后，与药品审批有关的一系列干部又相继落马，业内普遍猜测，如曹文庄等被拘，与新药审批中的灰色交易有直接关系。
因此，一年批一万个新药的事，就又沉渣泛起。对于业内流传的这一说法，有两个事实依据，并非完全空穴来风。
一个是直接依据，2004年，原药监局就受理10009种新药报批，其中没有一个是真正的新药即新化学实体，绝大部分是中国药典中已有的药物，仅是对剂量、给药途径或用法方面做了变更。而美国药监局同期受理新药报批数量仅148种，136种最终通过批准。
这似乎就是一年批一万个新药的信源之一，而在2005年10月，国家发改委公布1998年以来第17次药品降价通知，同时修订了政府制定价格的药品目录：由原来的1500种左右扩大到2400种左右，约占药品总数量的20%。然而，与前面16次降价令一样，药品一进入降价目录就消失，实质是进入了新药审批的灰色通道。这个数字说明了：政府定价药品约2400种，占药品总数量的20%，也就是说药品总数量在12000种左右；而一年申报新药高达10009种，正好说明市场上几乎所有的药品都是“新药”。
而这个恰恰就是业内一个“机智”的推测，准不准确，似乎只能见仁见智，不过这也确实折射了那几年的行业现状。
官方说法？
当然，针对这一说法，业内流传已广，原药监局也进行了反驳，声明一年批一万种新药，这个说法不准确。
原药监局的说法是，过去曾经一年批准一万多个药品注册的申请事项，不是批一万多种新药。
原药监局研究了一番，他们认为，大家讲的一万多种引用的数据是2005年原国家食品药品监督管理局批准的药品申请数量11086个，所以讲一万个，数据没有问题，但是一万个并不都是新药。一万多个药品申请里面包括新药1113个，改剂药1198个，仿制药8000多个，一万多个数据是这三个准确概念组合在一起的。
但是，这一迟到的官方回应总的来说并不令人满意。 如果把原药监局2005年一年的新药申请批准量由以万计压缩至以千计，并且精确到了个位，一共1113个，似乎意在说明有关情况并不像传说的那样严重。但这样的数量仍是美国FDA差不多十年的受理量，仍然是骇人听闻的。
一些业内评论专家认为，原药监局刻意引导大家认识中国国情，4000多家药厂才有一万个申请项目，平均一家2个，多乎哉？似乎不多。
自此以后，原药监局大幅度地收紧药品审批，为了避免批准新药太多，对于药品审批越来越严格，因此，此前的盛宴也在2007年宣布结束，很多人认为，2007年以后批准的药物，无论是疗效，还是质量，都更有保证一些。
随着最近启动的仿制药一致性评价，2007年的仿制药也被要求尽快进行一致性评价，而文件中提到的时间节点就是2007年。可见，这一年前的仿制药质量似乎存在某些隐患。
不过，对于跨国制药企业来说，三报三批等更加严厉的措施使得创新药物难以尽快在中国上市。而在2007年前的黄金时代，这些药物在华上市就快多了，一家着名的跨国制药企业曾经创造了年增长30%以上的业绩，也正是拜那个时代所赐，而如今，这种运气已经不再有了。
